Since 2021, Khan has led the ICC investigation in Venezuela, where President Nicolás Maduro is accused of arbitrarily detaining, torturing, and executing his political opponents.
He is a British lawyer specializing in international criminal law and human rights law. He has served as the Prosecutor of the ICC since 2021
Prior to this position, Khan was appointed Assistant Secretary-General of the United Nations and Special Advisor and Head of the United Nations Investigative Team to Promote Accountability for Crimes Committed by Da'esh/ISIL in Iraq, established by Security Council Resolution 2379 (2017), to support national efforts to hold Da'esh/ISIL accountable for crimes that may constitute war crimes, genocide, or crimes against humanity
In February 2021, Khan was elected Prosecutor of the ICC. In May 2024, the court announced requests for arrest warrants against Israeli Prime Minister Benjamin Netanyahu, Defense Minister Yoav Gallant, and Hamas leaders, including Yahya Sinwar, Mohammed Deif, and Ismail Haniyeh, on allegations of war crimes and crimes against humanity. In November of the same year, the court issued an arrest warrant for Netanyahu, along with Gallant and Deif. An arrest warrant was also requested for Myanmar junta leader Min Aung Hlaing
In February 2025, the US Treasury Department imposed sanctions on Khan, following US President Donald Trump's decision to impose sanctions on ICC officials due to the arrest warrants issued against Netanyahu and Gallant in connection with Israeli operations in Gaza. In May 2025, Khan temporarily stepped down from his position due to allegations of sexual misconduct. The ICC appeals judges ruled that they found "reason to believe there is cause for disqualification" in light of Khan's close family relationship with a member of the legal team representing the Venezuelan government before the court. The Washington Post reported on the conflict of interest allegations in September, as Venezuelan human rights advocates urged the International Criminal Court (ICC) to expedite its investigation into Maduro. Some critics expressed concern that Khan's sister-in-law, lawyer Venkateswari Alajendra, had joined the Venezuelan government's defense team before the ICC.
Subsequently, the Arcadia Foundation, a Washington-based nonprofit organization focused on promoting human rights and democracy, filed a formal request with the ICC demanding that Khan recuse himself from the investigation. The organization cited a "clear conflict of interest."
The court's appeals chamber initially dismissed the complaint but reconsidered it in February
In court documents, Khan denied the allegations of a conflict of interest with his sister-in-law. He said he did not discuss any confidential information with Alajendra, did not recall any conversations with her about general facts in the case, and did not participate in any meetings Alajendra attended in Venezuela. Last Friday, the appeals judges wrote that "given the close family relationship between the Attorney General and Ms. Alajendra, as well as their prior professional and hierarchical relationship, any fair-minded observer would reasonably expect bias." The judges ordered Khan to apply for relief from the Venezuela case within three weeks
